These Terms of Service ("Terms") govern your use of our website, online ordering system, and all purchases made from our bakery. By accessing our services, browsing our website, or placing an order, you agree to be bound by these Terms. If you do not agree to all of these Terms, please do not access the website or use our services. SECTION 1 – ARTISANAL NATURE & PRODUCT VARIATIONS All of our items are crafted by hand and produced in small, limited batches. Subtle Variations: Because every item is individually handcrafted, subtle variations in color, shape, size, and finish are a natural characteristic of our products. These variations do not constitute product defects and are not grounds for refunds, returns, or replacements. Availability: To maintain quality and freshness, items are made in limited quantities. Availability is not guaranteed, and items may sell out without notice. We highly recommend utilizing our pre-order system to secure your items. Images & Presentation: All photographs and visual representations on our website and social media channels are for reference only. While we strive for consistency, the final product delivered may vary slightly in appearance. SECTION 2 – THIRD-PARTY ORDER & PAYMENT PROCESSING (HOTPLATE) All online product orders, storefront checkout workflows, and financial transactions are securely processed and managed by our third-party platform partner, Hotplate. Platform Terms: By submitting an order on our website, you acknowledge and agree that your order and payment transaction are processed through Hotplate's platform, and you agree to be bound by Hotplate's Buyer Terms of Service and Privacy Policy. Financial Data: Kith & Kin Bakery LLC does not directly collect, store, or process your credit card or financial account credentials. Platform Liability: We are not responsible for any technical errors, payment processing failures, or service disruptions occurring within the Hotplate infrastructure. Any billing disputes related to platform operation must be handled in accordance with Hotplate's established protocols. SECTION 3 – WEEKLY SCHEDULE & FULFILLMENT We operate on a structured weekly baking and fulfillment cycle to ensure maximum freshness: Ordering Window: We accept online orders weekly until the ordering window closes on Saturday. Fulfillment Days: Local pickup and fulfillment are scheduled exclusively for the following Tuesday or Thursday, as selected by the customer during the checkout process on Hotplate. Customers are entirely responsible for collecting their orders within their designated pickup window. SECTION 4 – CANCELLATIONS, CHANGES & REFUND POLICY Due to the highly perishable, artisanal, and made-to-order nature of our products, our cancellation deadlines are strictly enforced: All Sales Are Final: Except as expressly provided below, once an order is confirmed and processed, we do not issue refunds, returns, or exchanges for changes of mind, personal taste preferences, or customer error. SECTION 5 – ALLERGEN DISCLAIMER Our kitchen operates using shared equipment and handles common food allergens, including wheat, dairy, eggs, soy, nuts (tree nuts and peanuts), and sesame. No Guarantee: While we take strict operational precautions, we cannot guarantee that any item is 100% free of trace allergens due to the risk of cross-contact. Customer Assumption of Risk: If you have a severe or life-threatening allergy, you are advised to reach out to us prior to ordering. By purchasing our products, you acknowledge that you have read this disclaimer and voluntarily assume all risks associated with potential allergen exposure. SECTION 6 – FRESHNESS, STORAGE & CONSUMPTION Our pastries are prepared without artificial preservatives and are best enjoyed on the day of purchase/pickup. Quality Changes: Texture and flavor are subject to change over time. Storage Instructions: Customers are responsible for following any storage and handling instructions provided by the bakery. We are not liable for the premature spoilage or degradation of products resulting from improper storage. SECTION 7 – TRANSFER OF RISK & PICKUP RESPONSIBILITY Transfer of Liability: Once an order has been picked up by the customer (or a designated representative) or successfully delivered to the provided address, full responsibility and risk of loss or damage are transferred entirely to the customer. Transportation & Handling: We are not liable for any structural or aesthetic damage, melting, or spoilage resulting from transportation, customer handling, weather exposure, or subsequent improper storage. SECTION 8 – PRICING & PAYMENT Pricing: Prices for our products are subject to change without notice. The final pricing for any order will be explicitly confirmed and locked at the time of purchase/checkout on the Hotplate platform. Payment: Full payment through Hotplate is required to secure and confirm any standard order or pre-order. SECTION 9 – LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY WASHINGTON STATE LAW, KITH & KIN BAKERY LLC, ITS OWNERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OUR WEBSITE, THE HOTPLATE PLATFORM, OR THE CONSUMPTION OF OUR PRODUCTS, EXCEPT IN CASES OF PROVEN GROSS NEGLIGENCE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SPECIFIC ORDER IN QUESTION. SECTION 10 – GOVERNING LAW & JURISDICTION These Terms of Service and any separate agreements whereby we provide you products or services shall be governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles. Any legal action, suit, or dispute arising from these Terms must be filed exclusively in the appropriate state or federal courts located within King County, Washington. SECTION 11 – CHANGES TO TERMS OF SERVICE We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website.
